S.18 Valuation/Diminution Valuation


Within the current climate all businesses need to ensure that they are receiving or paying the correct amount of damages upon lease expiry.  The level of damages for breaching a repairing covenant under a lease is controlled by Section 18 (1) of the Landlord & Tenant Act and provides a “cap” on the level of recoverable damages based upon the diminution (reduction) in value to the property.  This is a stated requirement of the Property Litigation Association’s Dilapidations Protocol and RICS Guidance Notes.
