Valuation

S.18 Valuation/Diminution Valuation

Within the current climate all businesses need to ensure that they are receiving or paying the correct amount of damages upon lease expiry.  The level of damages for breaching a repairing covenant under a lease is controlled by Section 18 (1) of the Landlord & Tenant Act and provides a “cap” on the level of recoverable damages based upon the diminution (reduction) in value to the property.  This is a stated requirement of the Property Litigation Association’s Dilapidations Protocol and RICS Guidance Notes.

Keppie Massie has a highly successful record and our valuers aim to explain and guide you through the process whilst undertaking the valuations (be that on behalf of a landlord or a tenant). Our coverage across all market sectors and holistic property consultancy services allows us to draw upon direct property knowledge and apply this to the circumstances relevant to the instruction, in addition to drawing on our own internal and external research library resources.
